It is not discrimination if you are forty years old or older. After being named the "Giant Killer", he was featured on the cover of Memphis Magazine in 1987 for his successful lawsuits against discriminatory employers and governments. According to the Age Discrimination in Employment Act of 1967, it is unlawful to discriminate a person based on their age in any aspect of employment. This includes hiring, promotions, compensation and benefits, working conditions, or termination. The federal age discrimination law applies to employees or job candidates who are over 40. It also covers employers with more than 20 employees. This law also makes it illegal for employers to take retaliatory action against employees who complain about what they believe is discrimination based on age. A federal Equal Employment Opportunity Commission must receive a complaint of discrimination before a potential employee or job applicant can file a lawsuit under the ADEA. Depending on the state in which the employer is located, an applicant or employee has 180 days or 300 to bring a charge of age discrimination with the EEOC.
