The trust document is a legally binding agreement that allows the transfer of certain assets to a trustee, while still alive. You can assign your assets within the trust to beneficiaries. When you die, the trustee is responsible for the distribution of the assets according to the terms laid out in your trust. The main reason why trusts are preferred over wills is that they avoid the probate process, which will have to go through. A will that is going through probate must first be "proven" by the judge and all assets then must be assessed and accounted for. Assets are allocated to beneficiaries after debts are paid. Probate is accompanied by court costs and sometimes attorney fees. The entire process may take up to one year. When a will is probated, anyone can view it. The trust will remain private after your death and won't need to be probated since the ownership is already in your trustee's name. You can also make changes to your trust while still alive, such as moving assets, adding beneficiaries, or renaming the trustee.
