The Petition for Dissolution must be served to the opposing party and filed in the appropriate court. After the other party receives a Petition, they have an opportunity to respond. The person filing for divorce must state in the Petition for Dissolution of Marriage what may be at stake, such as assets/debts and child/spousal maintenance, decisions, parental time/child custody or attorney's fees. In most divorce cases involving family law, the court will schedule an initial hearing to review your case by a professional in order to expedite its processing. The court professional can set a hearing for temporary orders if the parties cannot agree on an interim agreement for the payment of debts and child support or parenting time. A court can also order the parties to go through mediation before submitting the divorce to a hearing for a temporary orders or permanent orders. In some states, a waiting period is required before the court can issue a divorce. In many states, there is no option for an expedited divorce during the waiting period.
